Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the AfroBites mobile application, web applications, or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

AfroBites is a restaurant discovery, table reservation, and food ordering platform operating initially in Zimbabwe. The platform connects clients (diners), merchants (restaurants), and couriers (delivery drivers) through a mobile application and dedicated web applications for customers, restaurants, and platform administrators.

3. User Accounts

To access certain features of AfroBites, you must create an account. You are responsible for:

• Providing accurate and complete information during registration, including your first and last name, email address, and/or phone number.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised use of your account.

You may create an account directly, or by signing in with a third-party provider (currently Google). If you use a third-party sign-in, that provider will share your name, email address, and profile photo with us as permitted by your settings with that provider.

4. Account Verification

We may require you to verify your phone number and/or email address before you can place orders, make reservations, or access certain features. Verification is carried out using a one-time passcode (OTP) sent by SMS text message, email, or WhatsApp message, depending on what is available in your region. Standard message and data rates from your carrier may apply.

5. Orders and Payments

When you place an order through AfroBites:

• Payment is processed and confirmed before an order is submitted to the restaurant.
• A service fee of 10% is applied to each order total, charged to the client.
• Delivery fees are calculated based on distance where applicable.
• All prices are displayed in USD. EcoCash transactions are processed at the prevailing exchange rate.
• Refunds are handled on a case-by-case basis. Contact afrobiteszim@gmail.com for disputes.

6. Table Reservations

• Reservations are subject to confirmation by the restaurant.
• Clients may not cancel a reservation within one hour of the reservation time.
• Repeated no-shows may result in account restrictions.

7. Restaurant Merchants

Restaurants listed on AfroBites agree to:

• Provide accurate menu information, pricing, and opening hours.
• Fulfil confirmed orders in a timely manner.
• Pay the applicable annual listing fee after the free launch period.
• Pay a commission on delivery orders as agreed during onboarding.
• Ensure that any staff granted access to the restaurant's AfroBites dashboard comply with these Terms and keep shared login credentials secure.

8. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose.
• Submit false, misleading, or fraudulent reviews or orders.
• Attempt to reverse-engineer, hack, or disrupt the platform.
• Impersonate any person or entity.
• Use automated tools to access or scrape the platform.

9. Intellectual Property

All content on the AfroBites platform, including the logo, design, text, and software, is owned by or licensed to AfroBites. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

AfroBites acts as a marketplace connecting diners with restaurants and couriers. We are not responsible for the quality, safety, or legality of food prepared by restaurant partners. To the maximum extent permitted by law, AfroBites shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

11. Governing Law

These Terms of Service are governed by the laws of Zimbabwe. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the platform constitutes acceptance of the revised Terms.
